If plaintiff in an auto accident is only out his deductible, why is he able to sue for the entire amount?
After the accident, his insurance company pays his claim less the deductible, and he signs a subrogation release, surrendering to the insurer his rights to pursue the responsible tortfeasor to the extent he was already paid by his insurer. So how can he have standing to enforce rights against the defendant which he has surrendered to his insurer?
This was prompted by an episode of "Judge Joe Brown" in which the judge told a defendant that it didn't matter that the plaintiff was re-imbursed by his insurance, and could still come after the defendant for the whole thing.
I own two things. I own a car and I own some contractual rights with my insurer. You take one, and I can sue for compensation for my loss. The fact that I have also bought and paid for certain contractual rights doesn't change that.
